110年1月1日起調整基本工資，提醒事業單位（包含適用勞動基準法第84條之1工作者）應提早規劃，以符法令規定。

勞動部表示，基本工資自110年1月1日起，月薪由新臺幣（以下同）23,800元調整至24,000元，時薪由158元調整至160元，業經勞動部報請行政院核定後公告。

 

勞動部進一步說明，基本工資立法目的在保障勞工的基本生活，維持其必需的購買力。工資是勞工提供勞務的對價，其數額由勞雇雙方協商約定，但不得低於基本工資。凡是目前工資未達前開調整後金額之事業單位，屆時均應調高工資給與，對於按月計酬勞工不得低於24,000元，按時計酬者不得低於160元，按日計酬者之日薪，在法定正常工作時數內，不得低於160元乘以工作時數之金額。於計算勞工加班費時，亦應以調升後之金額作為計算基礎。請事業單位預為因應。

 

勞動部也提醒，雇主與適用勞動基準法第84條之1之工作者，約定並經核備之正常工作時間如超過法定正常工作時數，則該等之基本工資應按時數比例增計，並非仍以每月基本工資數額計給。

 

以保全業之保全人員為例，勞雇雙方如約定「按月計酬」且經核備之每月正常工作時數為240小時者，於檢視是否符合基本工資規定時，應以30,600元為其基準，其計算方式：24,000元+〔24,000/240x(240-174)〕，如當月延長工作時間48小時，且均在當日前2小時者，延長工作時間之工資（加班費）：應不得低於6,400元（24,000/240×4/3×48＝6,400），在此工時安排下，當月薪資合計不得低於37,000元。至約定按時計酬者，應以160元乘以經核備之每月正常工作時數為基準。
