勞工於職災醫療期間終止勞動契約退保，可繼續參加勞保並享有給付保障。

參加勞工保險之職業災害勞工，於職業災害醫療期間終止勞動契約並退保者，得辦理繼續參加勞工保險普通事故保險，至符合請領老年給付之日止，以確保老年及相關給付權益。

勞動部表示，依《職業災害勞工保護法》第30條及其相關規定，參加勞工保險之職業災害勞工，於職業災害醫療期間與雇主終止勞動契約並退保者，得透過勞工團體、原投保單位或逕向勞保局辦理繼續加保。已依前開規定辦理續保者，得請領同一職災傷病及其引起疾病之職業災害保險各項給付，以加強保障其遭遇職業災害後之基本生活。

勞動部提醒，職業災害勞工於職業災害醫療期間退保之日起5年內，可依上開規定辦理續保手續，相關程序或應備書件都可在勞工保險局網站查詢或下載(網址：https://www.bli.gov.tw)。
