【持續擴大「法律扶助」範圍,力挺勞工朋友爭取應有權利】
和大家報告!勞動部近期將修正「勞資爭議法律及生活費用扶助辦法」(下稱扶助辦法),規劃於明(115)年1月起施行。我們要做以下3點
*第一,勞工如果經過地方縣市勞工局調解成立了,如果雇主後續不履約,勞工向法院申請強制執行,這時候,勞動部有提供「律師協助」,讓勞工可以盡快取得權利。
*第二,勞工在訴訟時,被雇主刻意用「反訴」來因應時,勞動部也可以提供律師協助,讓勞工可以安心積極訴訟,維護自身權益。
*第三,針對中高齡勞工(45歲以上)勞工及身心障礙勞工訴訟期間生活費用扶助,由180天增加到270天,讓勞工在生活安定的情況下進行訴訟程序。
勞動部自民國98年起,與財團法人法律扶助基金會 @legalaidtaiwan ,合作推動法律扶助相關業務,迄今(114)年1月止,已提供逾3萬7千位勞工訴訟扶助。
勞動部也呼籲勞工朋友,如勞工有訴訟代理扶助,或訴訟必要費用的申請需求,可撥打法扶基金會全國服務專線412-8518(市話可直撥;手機請加02)洽詢。
